Do I have to pay tax on the income from the lawsuit?
No. This is compensation for damages, i.e. compensation for a loss incurred. This is 100 % tax-free.
Is there a cost guarantee?

What would happen if the case were lost in court?

In which years must the lorry have been purchased?
Between January 1997 and January 2011, leading European truck manufacturers such as MAN, Daimler, Iveco, Volvo/Renault, DAF and Scania entered into unlawful agreements. These related to list prices, the reduction of discounts and the passing on of costs for new emissions regulations (Euro standards).

The European Commission uncovered this anti-competitive behaviour and took legal action. As a result, affected customers of these manufacturers now have the opportunity to claim damages.

In which countries must the lorries have been purchased?
We can help in all EU countries. For countries that only joined the EU after 1998, from the date of entry. In the case of countries that have left the EU, up to the last year of membership.
How does this lawsuit affect the relationship with my dealer?
Not at all, as the lawsuit is directed solely against the manufacturer and the retailer is not even aware of this lawsuit.
Do I still have to own the vehicles?
No, the decisive factor is that you purchased the vehicles new in the period from 1 January 1998 to 31 December 2013.
Which documents are required?
Proof of the purchase of the lorry(s) is required for the claim. This can be an invoice, an order confirmation or a leasing contract. It is important that the document contains the following information: VIN number, net purchase price, date of purchase.
What can I do if I no longer have all the documents?
There are various ways of proving the purchase of your tractor units:
  • Older balance sheets in which the vehicles are listed individually under fixed assets
  • Ask the dealer whether invoices are still available
  • Proof of insurance that includes the purchase price and the VIN number
However, if the purchase cannot be proven, a complaint is unfortunately not possible.
Does the lawsuit affect my relationship with the dealer?
No, your dealer is not involved. The lawsuit is directed exclusively against the manufacturer, so the dealer is not involved and will not find out about it.
Can I continue to use vehicles that are still in stock?
Yes, you can continue to use your vehicles without restriction.
Can I receive compensation for vehicles purchased second-hand?
No, the vehicles must have been purchased new. Demonstration vehicles may also be eligible. In addition, the vehicle must have a gross vehicle weight of over 6 tonnes.

Isn't it already too late for a lawsuit?
No, a lawsuit is still possible until 2029.
Is this a class action?
No, not in the traditional sense. We offer customers with at least 150 lorries an individual claim. For smaller fleets, we form class actions with up to 500 lorries and a maximum of 50 plaintiffs. This size is particularly advantageous in court.
