What is the background to Booking.com's best price clauses?
Many hotels have been paying Booking.com excessive commissions for years. The reason for this are best price clauses that have been included in Booking.com's general terms and conditions since 2006 and that violate antitrust law. These clauses prohibited hotels from offering their rooms more favourably on other platforms or even on their own website. The German Federal Cartel Office declared this practice illegal in 2015. The case is currently before the Federal Court of Justice.
What is the background to Booking.com's non-compliant booking button?
Between June 2014 and December 2022, the booking button on the Booking.com website was labelled "complete booking". As there was no reference to the charge, the button was incorrect and the booking was not legally compliant. The European Court of Justice ruled that bookings made during this period were invalid. Hotels that paid commissions to Booking.com during this period can claim their money back.
Do I have to pay tax on the income from the lawsuit?
No. This is compensation for damages, i.e. compensation for a loss incurred. This is 100 % tax-free.
